These Terms of Use ("Terms") govern your access to and use of the thankai.net website (the "Site") and the AirVids Streamer application (the "App"), provided by ThankAI ("we," "us," "our"). These Terms cover AirVids Streamer, our screen-mirroring app; our audio app has its own AirAudio Terms of Use. By using the Site or the App, you agree to these Terms. If you do not agree, do not use the Site or the App.

01License to use the App

The App is proprietary software licensed, not sold. Your use of the App is governed by the license that accompanies it. Except as that license expressly permits, you may not copy, modify, distribute, sell, sublicense, reverse engineer (except to the limited extent applicable law grants a non-waivable right), or create derivative works of the App.

02Free, ad-supported app

The App is provided free of charge. Mirroring sessions are time-limited; you may optionally watch a rewarded video advertisement, served via Google AdMob, to earn additional streaming time. Watching ads is optional. By using the App you agree that ads may be shown, and you agree not to interfere with, block, or tamper with ad delivery, and not to attempt to fraudulently generate ad impressions, clicks, or rewards. Your use of these ad features is also subject to Google's applicable terms. We may offer an optional paid version (no ads and/or unlimited streaming time) or other in-app purchases in the future; any such purchases are processed and governed by the Google Play Store and its terms.

03Acceptable use

You agree to use the Site and App only for lawful purposes. You will not:

  • use the App with displays, networks, or accounts you do not own or are not authorized to use;
  • mirror, display, or distribute content that infringes any third party's intellectual property, privacy, or other rights, or that is unlawful;
  • use the App to bypass, remove, or circumvent any digital rights management or copy-protection measure;
  • attempt to gain unauthorized access to, interfere with, or disrupt the Site, the App, ad delivery, or any connected systems or networks; or
  • use the Site or App to violate the terms of service of any third-party device or service.

04Content protection

AirVids mirrors your own device's screen and audio. It does not defeat content protection: some apps or services may block or limit mirroring of their protected content, and the App respects those restrictions. You are responsible for the content you choose to mirror.

05Intellectual property

All content on the Site and all original portions of the App — including text, graphics, logos, and software — are owned by us or our licensors and are protected by copyright and other laws. Third-party trademarks remain the property of their respective owners and are used only for descriptive, interoperability reference (see the Disclaimer).

06No warranty

THE SITE AND APP ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT COMPATIBILITY WITH EVERY DISPLAY OR THAT MIRRORING WILL BE UNINTERRUPTED OR LAG-FREE.

07Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR USD $0 IF THE APP WAS PROVIDED FREE OF CHARGE). WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.

08Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Site or App, the content you mirror, or your violation of these Terms or any law or third-party right.

09Termination

We may suspend or terminate your access to the Site or App at any time, with or without notice, for any reason, including violation of these Terms.

10Changes to these Terms

We may revise these Terms at any time. Continued use of the Site or App after changes are posted constitutes acceptance of the revised Terms.

11Governing law

These Terms are governed by the laws applicable at ThankAI's principal place of business, without regard to conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the courts of competent jurisdiction at that location.
