Terms of Use

These Terms of Use ("Terms") govern your access to and use of the thankai.net website (the "Site") and the AirAudio Streamer application (the "App"), provided by ThankAI ("we," "us," "our"). By using the Site or the App, you agree to these Terms. If you do not agree, do not use the Site or the App.

01License to use the App

The App is proprietary software licensed, not sold. Your use of the App is governed by the license that accompanies it. Except as that license expressly permits, you may not copy, modify, distribute, sell, sublicense, reverse engineer (except to the limited extent applicable law grants a non-waivable right), or create derivative works of the App.

02Ads and rewards

The App is free and supported by ads served through Google AdMob. The App offers optional rewarded ads that you may choose to watch to earn additional streaming time. Any streaming time you earn is a convenience feature only: it has no monetary value, cannot be transferred, sold, or exchanged for cash, and we may change, limit, or discontinue it at any time. Your use of ads is also subject to Google's applicable terms and policies; see the Privacy Policy for what data the ads provider collects and how to control it.

03Acceptable use

You agree to use the Site and App only for lawful purposes. You will not:

• use the App with hardware, networks, or accounts you do not own or are not authorized to use;
• use the App or Site to infringe any third party's intellectual property, privacy, or other rights;
• attempt to gain unauthorized access to, interfere with, or disrupt the Site, the App, or any connected systems or networks;
• use the Site or App to violate the terms of service of any third-party device or service you interoperate with;
• interfere with, defraud, or attempt to manipulate the advertising in the App (for example, generating invalid ad activity); or
• circumvent any technological protection measure or use the App to do so.

04Intellectual property

All content on the Site and all original portions of the App — including text, graphics, logos, and software — are owned by us or our licensors and are protected by copyright and other laws. Third-party trademarks remain the property of their respective owners and are used only for descriptive, interoperability reference (see the Disclaimer).

05No warranty

THE SITE AND APP ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

06Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR USD $0 IF THE APP WAS PROVIDED FREE OF CHARGE). WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.

Some jurisdictions do not allow certain warranty disclaimers or liability limits. Nothing in these Terms limits rights or remedies that cannot legally be limited or excluded.

07Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Site or App or your violation of these Terms or any law or third-party right.

08Termination

We may suspend or terminate your access to the Site or App at any time, with or without notice, for any reason, including violation of these Terms.

09Changes to these Terms

We may revise these Terms at any time. Continued use of the Site or App after changes are posted constitutes acceptance of the revised Terms.

10Governing law

These Terms are governed by the laws of Wisconsin, United States, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin.
